Under the terms of AusLink (National Land Transport) Act 2005 (the Act), the Minister may approve a project as an AusLink National Project, if the Minister is satisfied that the project is eligible and considers that it is an appropriate project.
To be eligible a project must be on the National Land Transport Network. The Minister may have regard to a number of factors in deciding whether a project is appropriate, such as the National Land Transport Plan, any relevant Corridor Strategy and the extent to which the project will improve the efficiency, security or safety of transport operations on the National Land Transport Network. These factors are listed at Clause 11 of the Act.
The project approval instrument for an AusLink National Project may also require that a funding agreement be entered and list other requirements that must be complied with.
